Short answer

A fake Rolex is a watch that carries Rolex trademarks but was not made by Rolex SA. Rolex does not license its name to another maker. A watch sold as new by a seller outside the Rolex authorized dealer network is a counterfeit or a genuine watch that was sold before. Trafficking in counterfeits is a federal crime in the United States under 18 U.S.C. § 2320. The number of counterfeit Rolex watches made each year is not published.

Four terms, two meanings

  • Counterfeit: copies the Rolex name and crown logo. Illegal to sell in the US and most other countries. Customs can seize it.
  • Replica: the marketing word sellers use for a counterfeit. In law the two words describe the same object.
  • Homage: keeps a style such as a dive bezel or a black dial, but carries the maker's own brand name. Legal.
  • Frankenwatch: a genuine Rolex case or movement joined to aftermarket parts. Part real, part counterfeit, and outside factory specification.

Checks that take ten minutes

  1. Price. A new steel Rolex lists from about $7,000 to $15,000. Submariner, GMT-Master II, and Datejust sit in that band. A listing far below that figure is a counterfeit or a scam.
  2. Movement rate. Rolex automatic calibers run at 28,800 vibrations per hour, which is 8 beats per second. Many counterfeits use 21,600 vph movements. A smooth sweep alone does not prove a watch is real, because some fakes use 28,800 vph clones.
  3. Steel. Rolex cases use 904L stainless steel, sold as Oystersteel since 2018. Most counterfeits use 316L steel.
  4. Crystal. Since 2002 Rolex etches a coronet into the sapphire at 6 o'clock. The mark is a laser etching and needs a loupe to see.
  5. Rehaut. On most models built from 2004 onward, the inner ring carries an engraved "ROLEX ROLEX" repeat and the serial.
  6. Cyclops. The date lens magnifies about 2.5 times. Fakes show lower magnification or a date off center.
  7. Papers and box. A new Rolex ships with a warranty card that matches the serial, a box, and a booklet. Rolex sells through authorized dealers and does not run its own online store.
  8. Service. A Rolex service center confirms the serial and does not repair counterfeits.

What a counterfeit cannot copy

Genuine Rolex calibers carry Superlative Chronometer certification of -2 to +2 seconds per day, a standard Rolex has applied since 2015. COSC certification, used before that, allowed -4 to +6 seconds per day. A Submariner carries a 300 m water-resistance rating and a 70-hour power reserve in the current caliber 3235. A counterfeit case does not hold those numbers, and a pressure test at a service center shows it. Resale value separates the two groups as well. A genuine Submariner holds most of its retail price on the secondary market. A counterfeit has no resale channel outside the same counterfeit trade.

Law and border enforcement

The Trademark Counterfeiting Act of 1984 created the federal charge that now sits in 18 U.S.C. § 2320. A first trafficking offense carries up to 10 years in prison and a $2,000,000 fine. US Customs and Border Protection seizes and destroys counterfeit shipments at ports of entry. Watches and jewelry rank among the top product categories by seized value in CBP statistics. The criminal statute targets trafficking. A single personal purchase sits outside § 2320, but a seller faces civil claims under the Lanham Act.

Market size

OECD and EUIPO research puts counterfeit and pirated goods at up to 3.3% of world trade, about USD 509 billion, based on 2016 customs data. Watches sit in the top product groups in that study. No public source counts fake Rolex units sold per year.
